Acceptable Use Policy

1. Purpose

Reachmerce is a product operated by Kodensoft (kodensoft.com). In these documents, “Reachmerce,” “we,” “us,” and “our” refer to Kodensoft operating the Reachmerce services.

This Acceptable Use Policy (“Policy”) governs use of Reachmerce. It is incorporated into the Terms of Service and Master Subscription Agreement.

2. Lawful use

You may use the Services only in compliance with applicable law, carrier rules, Shopify policies, and this Policy—including telemarketing, TCPA/CTIA-style consent rules where applicable, privacy, consumer protection, recording, sanctions, and anti-spam laws.

3. Consent, DNC, and recording

You must obtain and document consent where required before calling or texting. Honor STOP, unsubscribe, and do-not-call requests promptly. Provide required call-recording disclosures. Do not contact numbers you know are invalid, recycled without consent, or on suppression lists you are required to respect.

4. Prohibited content and campaigns

You must not use the Services to:

• Send illegal, fraudulent, deceptive, or harassing communications.
• Impersonate another person or brand without authorization.
• Promote illegal products, hate, violence, or exploitation.
• Harvest personal data unlawfully or bypass security controls.
• Interfere with or overload the Services or third-party networks.

5. AI restrictions

Do not use AI voice or messaging features to mislead recipients about the automated nature of a call where disclosure is required, to generate unlawful content, or to automate decisions that violate applicable law. Review campaign prompts before activation.

6. Prohibited industries

We may restrict industries that carriers or payment providers prohibit (for example, certain high-risk financial schemes, illegal substances, or scams). We may refuse or suspend campaigns that create undue compliance risk.

7. Enforcement

We may investigate suspected violations, remove content, throttle or suspend workspaces, and report unlawful activity. Repeated or severe violations may result in termination without refund.
